By the closest of votes, 3-to-2, The Indiana Supreme Court strikes down Evansville's smoking ban. Lawyers for bar, tavern and private club owners had said the exemption of the Tropicana Casino violated the state constitution, and the state's highest court agrees. The state's Alcohol & Tobacco Commission says establishments that are no longer prohibited from allowing smoking as a result of the ruling must still follow the state smoking law.
